Will a Special Needs Trust disqualify my loved one from Medicaid or SSI?

A properly drafted third-party SNT does not count as a resource for Medicaid or SSI purposes. Your loved one continues to receive benefits, and the trust supplements those benefits without replacing them. Improperly drafted trusts — or direct gifts — can trigger disqualification.

What is the difference between a first-party and third-party SNT?

A third-party SNT is funded with someone else’s money — typically a parent’s estate. It has no Medicaid payback requirement. A first-party SNT is funded with the disabled person’s own money (such as a personal injury settlement) and does require repayment to Alabama Medicaid at the beneficiary’s death.

Can I just leave money directly to my child with a disability?

You can, but it can cause serious harm. A direct inheritance above $2,000 will typically disqualify an SSI recipient and may disrupt Medicaid coverage. Even well-meaning relatives — grandparents, aunts, uncles — who leave money directly can unknowingly eliminate your loved one’s benefits.
